PHOTO TRANSFER LICENSE AGREEMENT
A Photo Transfer License Agreement is a legal document that grants permission for previously licensed images to be reassigned from the original license holder to another authorized party (such as a new listing agent, brokerage, builder, or homeowner).
This agreement does not transfer copyright ownership. The photographer retains full copyright at all times. The agreement only transfers specified usage rights, which may include:
MLS and internet listing use
Marketing and promotional materials
Social media advertising
Print marketing for the specific property
The transfer applies only to the property identified in the agreement and does not grant unlimited or future usage beyond the defined scope.
There are two types of Photo Transfer License Agreement. Standard and Luxury
STANDARD LISTING TRANSFER LICENSE
Short Description
A Standard Listing Transfer License allows previously photographed real estate images to be reassigned from the original licensed agent to a new agent or brokerage for marketing the same property.
License Terms
1. Copyright Ownership
D Grant Media retains full copyright ownership of all images at all times. This license transfers usage rights only — not copyright.
2. Eligible Transfer
This license applies when a property listing transfers to a new agent or brokerage and the new party wishes to use the existing photography.
3. Permitted Use
The new license holder may use the images for:
MLS listings
Real estate portals (Zillow, Realtor.com, brokerage websites)
Property-specific websites
Social media promotion of the listing
Digital and print marketing for the specific property
4. Limitations
Valid only for the property address listed in the agreement
Valid only while the property is actively listed for sale or lease
Not valid for builder portfolio use, commercial advertising, branding campaigns, or future developments
Images may not be sold, sublicensed, or transferred again
5. Duration
License remains active until the property sells, is leased, or listing expires — whichever occurs first.
6. Alterations
Minor edits for formatting, cropping, or MLS compliance are permitted. Images may not be heavily altered, filtered, or manipulated without written consent.
LUXURY LISTING TRANSFER LICENSE
Short Description
A Luxury Listing Transfer License provides expanded marketing rights for high-end properties requiring extended exposure and elevated promotional campaigns.
License Terms
1. Copyright Ownership
D Grant Media retains full copyright ownership. This agreement transfers extended usage rights only.
2. Eligible Transfer
Issued when a luxury property listing transfers to a new agent, brokerage, or luxury marketing division.
3. Permitted Use
Includes all Standard License rights plus:
National and international marketing platforms
Luxury print publications and magazines
Paid digital advertising campaigns
Brokerage branding materials promoting the specific listing
Email campaigns and high-end property brochures
4. Extended Exposure Rights
Luxury listings may require longer marketing cycles. This license remains valid while the property is actively marketed, including temporary off-market repositioning periods of up to 12 months.
5. Limitations
Valid only for the identified property
Not transferable beyond the named new license holder
Not valid for builder developments or future construction marketing
No resale or third-party redistribution
6. Image Integrity
Professional presentation must be maintained. Images may not be altered in a way that misrepresents the property.

STANDARD LISTING TRANSFER LICENSE (less than $1mil listing) - $200
LUXURY LISTING TRANSFER LICENSE ($1mil or greater listing)——-$400
Why a Transfer Fee Applies:
Real estate photography is licensed to the original listing agent for marketing use. When a property transfers to a new agent, a new marketing license must be issued. The transfer fee covers commercial usage rights, administrative processing, and continued brand protection of the imagery.
